Accident at work compensation for injury due to poor lighting

If you have had an accident at work, compensation may be claimed if it can be proved that your employer was negligent and that the accident was not your fault.

There are many different types of accidents to be had in a workplace, but often overlooked are the accidents which could be caused by insufficient lighting in certain work areas.

Poor lighting in stairwells for example, or other places with low lighting, can cause people to fall. This could result in an injury which keeps the employee off work for a long time, or in severe circumstances, could leave them permanently disabled.

The Workplace (Health, Safety and Welfare) Regulations 1992 state that:

  • Every workplace must have lighting suitable and sufficient for the work being done.

  • Where possible, the rooms, corridors and stairwells should be lit by natural light.

Guidelines as to how strong lighting should be in certain work places, and in certain areas within those workplaces, are laid out by the CIBSE (Chartered Institution of Building Services Engineers) Code of Lighting.

Lighting guide for employers
There are a number of practical steps employers should take to avoid employees suffering a work injury.

Lighting should, as often as possible, come from natural light through windows. If that is not possible, however, electrical lighting must be used instead.

Direct light should not be in anyone's eyes, making it difficult for them to see. If the lighting is electrical, its placement in the building, or the position of the workers, should be thought out carefully. If natural light is predominant, it should be controlled by blinds.

The creation of heavy shadows should be avoided if possible, especially on stairs or ramps, as this may cause a tripping hazard.

To avoid the majority of problems caused by inefficient lighting, light switches should be easy to find and easy to reach. Light switches should be near doors into rooms, so that no one needs to walk into a darkened room to find the switch.
