Even health and safety inspections need to abide by appropriate regulations. This is because a health and safety inspector will be testing all aspects of a workplace's functioning and may have to do such things as simulate work with chemicals or that which involves being at height. Preparedness and risk assessment will be of the essence – the last thing the HSE wants is to be embarrassed by an inspector making a ladder accident claim.
Whether in a school, library, gym, other public building, or office, construction site, agricultural workplace or indeed personal injury solicitor's office, just like all workers, a safety inspector will have to be mindful of all possible risks associated with the relevant workplace environment.
Working from height is just one area that an inspector will have extensive formal training in. He or she should be aware of all the issues and will observe the mantra that employers and managers must do "all that is reasonably practicable to prevent anyone falling".
But, just as with any visitor, contractor or employee coming to a workplace, the health and safety inspector is, to some extent reliant on the good practice of the full-time management structure.
For example, if the inspector mounts a faulty or unstable ladder and suffers injury as result, it may be found that the workplace he or she was visiting is liable for any consequent ladder accident claim.
A spokesperson from no win, no fee claim specialist YouClaim comments, "As novel as the idea may seem, even health and safety inspectors are entitled to make claims for compensation in the event they suffer injury in a workplace accident that has been caused by the negligence of another party.
"This fact helps remind us that all potential claimants are equal in the eyes of the law."
