Keep diaries and documents if considering a medical negligence claim


Like any personal injury case - any legal case at all, in fact - a medical negligence claim will rely heavily on written evidence. For this reason, it is wise for anyone suspecting that their care or treatment is proving substandard to ensure that any correspondence with the medical professional providing that care is kept somewhere safe.

It may also be advisable to keep a notebook that contains records of telephone calls and conversations that may be useful in a potential compensation claim. Keeping a diary of events may prove to be useful too.

Doctors are urged by their union to ensure that all their notes are kept on file; that body draws attention to a 2009 case which was successfully defended on the strength of the paper records that the GP practice was able to produce. Having one's own records may help a claim stand up to copious medical notes that a defendant can produce; in cases where the notes are thin, lost or non-existent, they may carry even more weight.
