Irish pork recall causes product liability insurance woes for farmers

In December 2008, a product liability scare regarding pork food products caused many financial problems for the pig farmers involved.

Several Irish farms producing pigs for the food industry were affected by contaminated animal feed. According to the Food Safety Authority of Ireland (FSA) dioxins entered the food chain after animal feed from a particular producer was tainted with an industrial oil. Health officials found levels of dioxins in affected pigs and pig meat at 80-200 times the safe limit.

However, although the number of farms affected was small, widespread contamination occurred as contaminated pig meat entered food manufacturing plants and was mixed with uncontaminated meat.

Dioxins usually occur as a result of industrial combustion and other chemical processes. High level exposure to dioxins is linked to increased incidence of cancer.

A toxicologist from Imperial College in London said, "These compounds take a long time to accumulate in the body, so a relatively short period of exposure would have little impact on the total body burden. One would have to be exposed to high levels for a long period of time before there would be a health risk."

Major food supply outlets temporarily removed Irish pork products from their shelves, but the food product liability scare was short-lived and concerns regarding the health risk to the general public were quickly negated.

After the mass product recall, farmers were further thwarted as financial experts warned that insurance policies purchased to protect against the costs of such a product recall may not pay out. It was suggested that underwriters typically include exclusion clauses in product liability indemnity policies for contamination by carcinogens, such as the dioxin which entered the animal feed.
