Making asbestos claims against companies which have closed down

People with asbestos-related diseases such as mesothelioma or asbestosis may be detered from making an asbestos claim due to the time that has lapsed between when they were exposed to the deadly dust and when they first started experiencing symptoms. As the effects of asbestos can take up to 15 years to show, some companies where sufferers were exposed to the asbestos will have closed, making their insurance companies hard to trace.

However in 2010 a leading insurance company called on other insurers to ensure that sufferers of asbestos-related diseases get suitable compensation for their illness. Co-Operative Insurance made the plea to other insurance companies after it raised concerns that thousands of people from the industrial sector who have been exposed to harmful substances such as asbestos, are not getting the compensation they deserve.

A Co-Operative Insurance spokesperson said the company is "Calling on the industry to work together to ensure that individuals and families affected by asbestos-illness can access compensation whether it is provided by an individual insurer or the industry as a whole.

As well as having to deal with the diagnosis of what can be a life-threatening illness, many sufferers have been unable to claim compensation because their past employer has since ceased trading and the insurance provider cannot be traced.

The Co-Operative Insurance encouraged other insurance firms to work together to help individuals and families affected by asbestos-related illness gain compensation whether it is provided by an individual insurer or the industry as a whole.

Employees who now suffer illnesses due to exposure to asbestos at work deserve to gain compensation, regardless of the length of time which has passed.

Provided that the relevant insurance company can be traced, it is immaterial whether the employee's former company has since ceased trading as the claim will be made directly against the insurance company.
