Embarrassment and deafness compensation claims

It is difficult to ascertain just how many workers in the UK suffer from hearing loss that, through fear of stigma, embarrassment or losing their jobs, they fail to disclose to their employers. Of course, one of the sad ironies for those in this situation is that the hearing loss may have its origins in workplace noise and could be, as such, actionable under the terms of a deafness compensation claim.

What is clear is that the fact of hearing loss does not mean that workers should automatically be considered any less valuable than their full-hearing counterparts. Even in cases where deafness is significant, there are plenty of adjustments that can be made, on the part of both employers and workers, to help those affected make the transition from full to reduced hearing.

However, many still continue to fear discrimination, embarrassment and, potentially, loss of employment.

While these responses are both human and understandable, it is worth remembering that workplaces have a duty to be supportive and non-discriminatory – there are relatively few professions where it will become impossible for the affected worker to continue in, or at least redefine, his or her role in an organisation.

It is also worth remembering that the deafness may, in fact, have been caused by workplace factors, such as long-term persistent noise, sudden acoustic shock or other, more complex, medical factors.

Consulting a GP or a specialist about these and discussing them with the workplace's health and safety manager will help the worker decide whether it might be in his or her interests to proceed with a deafness compensation claim. Although, of course, there is no substitute for good independent legal advice such as that provided by our esteemed no win, no fee team.

Claim compensation for deafness caused by workplace conditions
If your hearing has deteriorated, whether suddenly or gradually, as a result of your working environment or a workplace accident, it is likely that you are entitled to make an industrial deafness compensation claim.

Employers' duties to protect the hearing of workers are enshrined in the Noise at Work Act 1989 and any failure to maintain these duties may result in negligent employers being considered liable for compensation.

Here at YouClaim, we allow affected workers to secure their legal rights without them ever incurring any financial risk. Win or lose, we guarantee that you will never incur a single penny in costs, fees or disbursements, from either us or the opponent.

You will find extra peace of mind in our 100% compensation guarantee – we never take a cut.
