In September 2009, after having to seek treatment for tinnitus, a soldier claimed against the Ministry of Defence for industrial deafness and won £330,000 in compensation.
Having been told not to wear earplugs during a training exercise to make it more "battle realistic," the soldier was left with hearing damage and tinnitus causing him to suffer from a permanent "fuzzy noise" in his left ear.
Due to his hearing problems, the soldier was discharged from the army on health grounds in 2007. Satisfied that it was the soldier's intention to continue in his career, the judge awarded him compensation and found the army liable for leaving the soldier "disadvantaged in the labour market."
The case highlights how it is the employer's responsibility to provide employees with ear protection to prevent against damage to recruits' ears. With soldiers in close proximity to repetitive loud noises such as rifle fire, damage can be done to the sensory cells in the inner ear resulting in hearing problems such as tinnitus.
