Noisy toys and deafness compensation claims

The last thing we expect when buying a son, daughter, niece, nephew or grandchild a birthday or Christmas present is that it might cause hearing loss and consequently be the precursor for a deafness compensation claim.

Although the British and European Standard for toys oblige manufacturers to ensure that when held 50cm from the ear toys must not exceed noise levels of 80dB, organisations like Deafness Research UK firmly believe that a noise level of 85dB when a toy is held 25cm from the ear is a far safer and more sensible guideline.

In a startling discovery, a landmark study carried out by Deafness Research UK in conjunction with UCL's Ear Institute found that a large number of toys available on the UK market pose a significant risk to the hearing of children.

They subjected 15 different toys that are currently available on the UK market to rigorous testing and found that 14 of them emitted noise above their recommended safety level.

Not surprisingly, the most persistent offenders were toy guns. Three of the toy guns were found to produce noise levels of up to 143dB, a level which is more consistent with a working environment such as a music studio or civil engineer's workstation.

It is a possibility that, in exceptional circumstances, even when the packaging of such toys bears the prescribed proviso, "Warning! Do not use close to the ear! Misuse may cause damage to hearing," parents of children who experience hearing loss as a result of excessively noisy toys may still be able to make deafness compensation claims on behalf of their child.

If a noisy toy causes hearing loss and fails to carry this warning, access to deafness compensation should be more straightforward.
