An industrial deafness claim can be made in the event that a worker suffers sudden or gradual hearing loss that is attributable to workplace conditions, whether short-term or long-term exposure to excessive noise, or a sudden traumatic work accident.
However, every year in the UK there are thousands of cases of sudden sensorinerual hearing loss (that which is dramatic and occurs within three days) for which those affected are unable to claim deafness compensation.
It is not known how or why the vast majority of these cases occur – however, it is thought that certain viruses and infections have a significant part to play. Again, their pathology in the process is not clear, but it is thought that the infection or virus somehow causes nerve damage.
A consultant from the Royal National Ear, Nose and Throat Hospital in London explains, "There may, for example, be a serious injury to the head which damages the cochlea or auditory nerve, or an illness such as meningitis, mumps or shingles which can affect the nerve or damage the cochlea."
"Doctors can only identify a definite cause in a small percentage of cases," adds the professor.
Statistics confirm this statement: in only 15% of sudden sensorineural hearing loss is the cause known, meaning that 85% of cases are idiopathic.
Those causes which are sometimes identifiable include: noise, head injuries, infection, meningitis (which usually causes bilateral deafness), barotraumas, ear surgery, immunological deficiency, meniere's disease and ototoxicity. In these cases, those affected may be able to make an industrial deafness claim for 100% compensation.
Fortunately, not all cases of sudden deafness are permanent. In fact, approximately 70% of patients' hearing returns to normal or near-normal levels after a number of weeks or months. But even with full recovery, the journey and experience of sudden deafness can be both traumatic and unsettling.
However, some cases are permanent and those affected must face serious and dramatic life changes.
