When making a compensation claim against a negligent employer whose actions have been attributable in an employee's injury or disease, it is the company's insurer who will be liable for any damages awarded. However, many work-related complaints such as for asbestos cancer or an industrial deafness claim usually occur many years after the employee has ceased to work for the company and they may have since ceased trading.
Just like mesothelioma (the aggressive cancer caused by asbestos) the effects of exposure to work-related noise can take many years to present themselves. In July 2009, one such case came to light where a wool worker, suffering from noise induced hearing loss, made appeals through his local paper for information regarding his former employer's insurers, so that his personal injury solicitors could make a claim for compensation on his behalf.
The 67-year-old man had worked at two textile companies that produced wool from 1962 to 1989, where he worked on noisy wool-winding machinery.
The man told local press that one company employed over 500 people in its Bradford factory where many winding machines were operated at the same time. The machines required four people to work them and were extremely noisy. He says he was not provided with hearing protection equipment and has now been diagnosed with industrial deafness after an audiometry test concluded that his hearing had been seriously impaired.
The ex-textile worker said, "There must be lots of people living in the Bradford area who came into contact with [the textile companies] and if we all pull together we can claim what is rightly ours. You do not realise how much your everyday life depends upon your hearing until you are affected by hearing loss."
