Industrial deafness claims in retrospect

Many compensation claims are made for industrial diseases such as mesothelioma and asbestos cancer where the disease is only diagnosed a number of years after the patient has stopped working in the environment that is to blame for the illness. However, it is possible to settle industrial deafness claims in the same manner if hearing damage occurred whilst the patient was at work.

In April 2009, one such case came to light when a former railway worker from Swindon made a claim against British Rail for noise induced hearing loss.

The ex-employee worked as a fitter, turner and erector for British Rail from 1956 to 1982. His work included long periods of time in the boiler shop where exposure to high levels of noise from pneumatic drills was a regular occurrence. The worker alleges that he and his co-workers were never warned of the dangers related to noise exposure and were not supplied with hearing protection.

The personal injury solicitor acting on behalf of the Swindon man suggested that many ex-workers who find themselves with hearing deficiencies in later life do not associate it with working conditions that may have occurred years ago.

She said, "Many just think it is old age. However, if they have been employed for many years in a noisy environment that may well be the cause of their deafness."

The ex-British Rail worker, who now requires hearing aids, settled his industrial deafness claim and received £14,000 in compensation.

His solicitor noted that workers should be aware of the three year limitation on bringing claims against employers once the diagnosis has been made. If the cause of hearing impairment is established as being a result of excessive noise levels at work, the sufferer should therefore seek advice from a no win, no fee lawyer as soon as possible.
