Industrial deafness and the waiting game

In most workplace scenarios personal injury sustained at work is immediately apparent – injuries may occur after an accident at work and an employee can commence a claim for compensation as soon as liability for the accident is established. The 64-year-old Sheffield man had worked on two major projects in the region, the hole in the road at Castle Square from 1963 to 1969 and the Hallamshire Hospital between 1974 and 1977, and at both of those times was exposed to excessive noise from pneumatic drills and other power tools and macninery.

His hearing was permanently damaged as a result and he was left unable to hear normal conversation and high pitched noises such as birdsong. Eventually he required hearing aids.

With the help of a personal injury solicitor specialising in industrial deafness claims the man took Sheffield Council to court pleading that they had failed to provide him with suitable hearing protection.

The claimant said, "Both jobs involved digging and construction work so I was working with loud machinery such as pneumatic drills and JCB diggers. My loss of hearing means that I now struggle to hear everyday conversations and it can be quite embarrassing when I have to ask people to repeat themselves several times."

His personal injury solicitor said, "Noise-induced deafness can take a number of years to develop, and it's quite possible that a number of [my client's] colleagues, through no fault of their own, will have suffered similar injuries as a result of their exposure to noise.

"Employers must understand the need to provide the correct equipment and protection to their employees, as [my client's] injuries would have easily been avoided with basic hearing protection."

The claim was settled out-of-court for an undisclosed four figure sum.
