Compensation for tinnitus is commonly made by those who work in an industrial setting or perhaps in a rock group. However, any burst of loud noise can trigger the condition and leave sufferers with the debilitating ringing sensation which can be impossible to get rid of.
Working as a college lecturer seems an especially unlikely career to cause the condition as it is usually associated with quiet study rooms – not the kind of place where hearing damage would be a problem.
However, one college lecturer was left with severe hearing loss and tinnitus after being exposed to excessive noise at work. Not working in the average lecture room, the teacher was exposed to prolonged bursts of loud noise from the workshop-based lessons he gave on motor vehicle body work. Despite working regularly with impact chisels, a type of pneumatic tool, the lecturer was not given any hearing protection and so was not protected from the high level of noise the pneumatic machinery gives off.
After receiving confirmation of his condition, the lecturer claimed for compensation for his personal injury against the college where he worked and managed to reach a settlement out of court.
Speaking about his compensation claim, the lecturer said, 'People told me for a number of years that I was going deaf but I didn't believe them. We weren't provided with hearing protection and the room wasn't sound-proofed but we were being exposed to the noise over a long period of time most days.'
This shows how occupational deafness can affect those working in a number of different industries. Employers must be aware of their responsibilities towards their staff’s health and wellbeing to ensure work-related injury, such as industrial deafness, is prevented.
Employees have a right to remain protected from excessive noise and their employers have a duty to ensure their hearing remains protected whether this be through providing ear defenders or sound-absorbing walls.
