Unfortunately, in some industry sectors, noise at work is unavoidable. However, factory and company owners / managers are required to keep noise below certain levels. The Control of Noise at Work Regulations 2005 (the Noise Regulations) is the relevant statutory instrument for the limitation of dangerous work practices involving noise. If employers adhere to the stipulations contained therein they will reduce their likelihood of facing a claim for tinnitus from an injured employee.

The Noise Regulations state that the level at which employers must provide hearing protection and hearing protection zones is 85 decibels (daily or weekly average exposure) and the level at which employers must assess the risk to workers' health and provide them with information and training is 80 decibels.

Workers must not be exposed to noise over 87 decibels, but this figure may take into account a reduction in exposure which appropriate hearing protection, used correctly, provides.

Preventing a claim for tinnitus
There are a number of steps which can be taken to prevent employees from suffering noise-induced hearing loss, particularly where the wearing of ear defenders may hinder a worker's ability to follow instructions or communicate with other workers to ensure safety.

Initially, a noise control project would involve detailed diagnostic readings of noise and vibrations to identify major noise sources, radiating surfaces and paths of noise transmission for each individual machine and work process.

These diagnostics form the basis for deciding if the noise can be suppressed at source or whether they will require large scale solutions such as the building of an acoustic enclosure, screen, noise control guard, acoustic hood, or the fitting of wall and ceiling sound absorption panels.
