An industrial deafness claim made by a call centre operator
There are many lines of work in which employees risk suffering permanent effects of industrial deafness. Those occupational fields which are typically thought of as being noisy include factory work, agriculture, road repair work, and ship building.
However, many people have been working for years in professions only recently recognised to be causing hearing damage. These professions include teaching, call centre work, serving in pubs and restaurants, and playing in orchestras. Read more about professions at risk of industrial deafness.
One customer that we helped to make an industrial deafness claim had been working in a call centre for 15 years.
Case study - Call centre operator
Our customer, a 50-year-old woman, was employed by a large retail company as a call centre operator.
She spent much of her eight-hour day on the telephone using a headset to speak to clients.
Unfortunately, on more than one occasion she experienced extremely loud noises on the line. Each time, she assumed the change in her hearing after the event was just temporary hearing loss but after several experiences of these loud bursts of noise found that the symptoms did not fade.
She decided to go to her GP, who diagnosed acoustic shock, a type of permanent industrial deafness. She was devastated by the diagnosis since she would not be able to continue in her line of work, which she had enjoyed for many years.
She decided to seek personal injury compensation for her damaged hearing so she came to YouClaim. We agreed to help her on a no win, no fee basis and arranged for one of our panel of solicitors to begin looking into the circumstances of her case.
It was found that her employers had failed to control the level of noise on the telephone line as effectively as they might and they had never educated the workers as to the effects of noise on their hearing. She informed us that some of her colleagues regularly complained of tinnitus after a day's work.
Despite this clear evidence that the company had caused our customer to suffer industrial deafness, it took ten months for them to admit liability. Our panel of personal injury solicitors were then able to agree a five figure settlement for our customer.
