Accident at work investigations from the HSE

Following an accident at work, it is possible that a company will be visited by the Health and Safety Executive for an inspection.  Certain types of accidents will make an inspection compulsory, but others may arise unexpectedly if the HSE uses its discretion, so it could well be wise for anyone who may be involved in such an investigation - which could be employers and workers - to have an understanding of what that might involve.

For most work accidents, the investigator will be part of the HSE's Field Operations Directorate; however, cases in mines or nuclear plants, for example, come under other departments within the safety body.

The first drive of an HSE investigation into a work injury, or a near miss, is to establish what happened to which people, and how.  It is only once the details of the accident have been established that the investigator begins to explore the reasons why it happened. 

As well as the worker who suffered personal injury, if possible, the people that will be interviewed could include other people involved in the activity that led to the accident, witnesses, and managers with a duty of care toward the person or people involved in the accident.  The investigator will be looking for evidence, from interviews and physical evidence, that shows whether the systems of work in place were unsafe or not.

If the evidence does show that the work injury resulted from failures in the employer's safety systems, the HSE may choose to prosecute, but this is not its only option; it may also choose to issue a notice, or to give advice to the company.  Alternatively, an investigation may show that the employer did everything in his or her power to prevent work accidents from happening - or that insufficient evidence is available to decide the issue either way.
