In an emergency situation, timing can be everything with split second decisions meaning the difference between life and death for critically ill patients. In the majority of cases, the Accident and Emergency (A&E) departments around the country provide an invaluable, life-saving service. However mistakes can, and do, happen and unfortunately hospital claims are made every year for medical negligence that has taken place in A&E.
In 2005, a Rotherham man was left with an incurable condition due to a medical mistake that occurred while he was being treated for a heart complaint. The man had been rushed into Rotherham District Hospital suffering from heart problems and was treated with the antibiotic gentamicin.
Unfortunately they gave him twice what is considered a safe dose and this has left him with ototoxicity which is an incurable condition that has symptoms similar to being drunk. The claimant now suffers from double vision, balance problems and dizziness. He is unable to work or leave the house without his wife or children to aid him. While out and about he is often greeted with disgusted stares as people mistake his swaggering for drunkenness.
The Rotherham man started his compensation claim in 2006 but was initially ignored by the NHS Trust until 2010 when he was finally awarded £575,000 in compensation. Due to the prolonged settlement of the case, the legal costs spiralled and it was argued that settling the claim earlier would have been beneficial for both parties.
When in hospital, you place your trust in the healthcare professionals that treat you. Medical negligence can destroy that trust and seriously prolong, and in some cases prevent a full recovery.
If you have been affected by a medical mistake, you could be eligible for a compensation claim.
