Homeowners beware of liability for work accident compensation

As a homeowner, where would you stand if a gas metre reader tripped on unsecured carpet and injured himself while inside your home? Or if a milkman was hurt by falling roof tiles as he delivered your daily pint whose fault would it be and who would pay any work accident compensation?

Quite simply, if a homeowner is found to be culpable for any injuries sustained by another party whilst on their premises, they will be held accountable for personal injury compensation. Damages may be awarded for loss of earnings, pain and suffering, medical expenses and any other items which a judge may see fit depending on the severity of the injury and its impact on the injured party's future.

In most cases, a homeowner's buildings insurance will have a public liability portion of the cover which will typically have a payout limit of up to £1million. This could be invaluable if a worker comes onto your property or enters your home and is injured in a work-related accident which could be deemed to be your fault.

In an unfortunate case, reported in July 2010, a woman who had not kept up payments on her house insurance was successfully sued by a postman who had suffered severe knee injuries after tripping on paving outside her house.

The worker required keyhole surgery to repair a torn ligament in his knee and was unable to continue his career as a postman because he was unable to walk long distances. He successfully returned to work as a handyman, but his earning potential was lessened.

The postman's personal injury solicitor wrote several letters to the homeowner regarding the personal injury accident, but it was alleged that no replies were received. Eventually, a judge ruled that the postman should receive work accident compensation. It was reported that he was claiming £34,000 with costs of a further £34,000.

Sadly, it was also reported that by not having an insurance policy with public liability cover the home owner would be faced with trying to raise the compensation payment and all legal costs out of her own pocket.
