Caving, potholing, spelunking - and a holiday claim

While the usual image of a holiday claim involves some form of personal injury incurred on a beach or a ski slope, there are many other kinds of vacation activity that can result in an accident.

One of these activities where an injury could be most serious is caving. The pleasures of this activity include testing yourself against the physical constraints of the small spaces and the psychological constraints of claustrophobia and the lightless environment, but these are also the elements that make it so difficult to extract an injury victim.

The American National Speleological Society warns that "Even an injury that is minor at home, could put your life at risk in a cave. Rescuing a person from a cave is a very technical and difficult operation." There is no reason that this should be different on a UK caving holiday.

Research undertaken in 1999 into caving injuries suggested that the rate of injury was approximately one per 2000 hours in a cave, with women being more likely to suffer a personal injury while spelunking than a man. The same research also suggested that many accidents are preventable.

The potential for a compensation claim following a caving accident may depend upon whether the party responsible for the cave has done everything necessary to prevent an accident, ie undertaking risk assessments and acting on any issues thrown up by that. A no win, no fee lawyer will be best placed to explain how personal injury law applies in each individual case.
