The perils of slips trips and falls on board a cruise liner were once again highlighted in 2009, when a woman successfully made a holiday claim against a Caribbean cruise company.
Many holiday claims, especially slips, trips and falls, are usually entirely preventable and are exasperated by the fact that the injured party is not always looked after to the standard that we would expect if the accident had occurred at home.
The case in question occurred on board a "navigator class" vessel when the 46-year-old woman, on holiday with her family, slipped on melted ice-cream. The ice cream had spilt from a faulty machine and had not been cleared up.
Although cruise staff rushed her to the on-board clinic facilities it was two days before her injured arm could be successfully set in a hospital in Monaco.
The woman was unable to return to work for one month after the accident, could only resume work on light duties, and suffered continued pain in cold weather.
The cruise company admitted liability for her accident and paid the woman an undisclosed amount of holiday claim compensation.
Her husband said of the case, "This accident completely ruined our holiday and my wife was forced to take sick leave from her job. The cruise company should have replaced the faulty machine before such an accident could happen."
