Holiday accident and supervised tourist activities

Some holiday accidents are impossible for the victim to avoid and are the fault of another individual, a group of individuals, failure by an organisation or caused by an unforeseeable event.

However, other incidents could be avoided if some common sense was displayed.

Some holiday resorts are situated in an area which includes activities that are not monitored by the owners of the complex, and, as such, tourists who decide to participate in the activity do so at their own risk.

If anyone is injured in a non-fault accident while swimming in the hotel pool, they may be able to claim from the hotel owners. Similarly, if they are injured while on a tour of some ruins because a paving-stone was unstable, they may be able to claim from the tour operator.

Yet, if an individual has chosen to visit a holiday resort next to a mountain which he or she decides to climb, any injury sustained is likely to be determined as their own responsibility.

Where the holidaymaker has chosen to undertake an activity which is not supervised by any type of authority, any potential risks should be carefully considered.

For instance, there is a big difference between walking in the English countryside and tackling a steep climb up a large mountain which has difficult terrain, and holiday-makers should not overestimate their own capabilities.

Someone who is fit and healthy, has the correct footwear and equipment, and who has experienced a mountain trek before, will probably be much less at risk of personal injury than someone who does not have the physical stamina necessary, has not climbed before, and who is unaware that certain clothing will be less appropriate than other types.

An unprepared person is at a greater risk of slips, trips and falls, and becoming dehydrated during the climb. Someone prepared will probably know what may be awaiting them, so is likely to have shoes with good grips and may have chosen to bring more water and energy-food to help them to the top without incident.

Experienced climbers may also be aware that setting off too late in the day will mean that they may have to make the climb back down in the dark. Anyone who has not thought of this eventuality may seriously injure themselves climbing down steep, hard or jagged terrain without the aid of a powerful torch.
