All hotels have a responsibility to ensure the safety of their guests. Of course, this includes keeping premises free of slip and trip hazards as well sources of food poisoning. However, one aspect of hotel safety that can sometimes be overlooked is the potential of guests suffering carbon monoxide poisoning, which, as well as having the potential to end in death, may also result in liable parties facing a holiday accident claim.
There are numerous examples of those affected by carbon monoxide poisoning in hotels instructing solicitors to make a holiday accident claim.
Claimants both here and abroad have achieved success in securing settlement for death and injury caused by the negligence of hotels, tour operators and contractors in ensuring the safety of hot water and heating systems in hotels.
For example, in 2010 an American woman secured a six-figure holiday accident claim after her husband suffered fatal carbon monoxide poisoning while staying in a Philadelphia hotel. The woman's no win, no fee solicitors succeeded in proving that both the hotel and the contractors that had been charged with repairing the hot water system were negligent in causing the circumstances that led to the man's death.
Here in the UK, there have been several carbon monoxide-related incidents at hotels across the country. In 2008, coroners found that the death of a man at a Cornwall hotel was caused by inhalation of the deadly gas; while in 2006, two guests at a Liverpool hotel became ill after problems with a faulty boiler led to them inhaling the gas.
Many people will remember the tragic deaths of two children from carbon monoxide poisoning whilst on holiday with their father in Corfu in 2006.
Incidents such as these have led to calls for greater protection from CO poisoning. A British member of the European Parliament comments, "I would like to see a requirement for all new homes and hotel rooms where gas is used, to be fitted with an alarm and for landlords and hotel managers to provide an alarm before they can receive their gas certificate."
