Many people are able to make there own holiday accident claim after suffering a personal injury as a tourist.
However, if they are under the age of 18 their parents or guardians will have to pursue compensation on their behalf.
This can occur even if the adult was not present at the time of the incident which caused the minor their injury, for example during a school excursion or young people's organised expedition.
Parents and guardians will often need to sign a form prior to their child's departure in order to pass responsibility for the young individual to whatever adult is in charge of the trip.
When the parents can no longer look after the safety of their child, teachers or expedition leaders should act in loco parentis to the under 18s in their care.
Failure to do this could result in one or more of them suffering personal injuries, or, in the worst case scenario, death.
In 2011 some children were injured and one lost their life during a British Schools Exploring Society expedition on the Norwegian Arctic island of Svalbard. A starving polar bear attacked a group of the children when they were asleep in their tent.
Investigations found that flares attached to a tripwire which was set up around the camp to warn a lookout or guard dogs of wild animals, had not been fixed into the ground well enough to go off when the bear trod on the wire. Furthermore, no lookout or guard dogs were in place and the expedition leader's rifle failed to fire four times when he tried to defend the group.
As a result, one 17-year-old boy was killed by the animal, and a 16 and 17-year-old were both severely injured in the incident.
Thankfully this type of unfortunate incident is unusual, but it is vital for the safety of all young people on any excursion that the adults in charge follow all health and safety procedures necessary in the environment they are in, and check equipment thoroughly before setting off.
