Making a holiday accident claim in an art accident

City breaks can easily lead to accident claims. One unusual example of the truth of this is the history of compensation claims made for personal injury received in art galleries.

Tate Modern and personal injury
Tate Modern, an established part of London's riverside skyline and its art scene, has faced claims for personal injury compensation for both of its most recent large-scale Turbine Room installations.

The current piece, Shibboleth, is a 'negative sculpture' by Doris Salcedo - rather than bringing carved material into the gallery, she has carved material out of the gallery to create a long, expanding crack across the floor. Whether through inattention or too-close attention, some gallery visitors have fallen in to this crack, receiving personal injuries.

Previously, Carsten Holler's installation of twisting slides brought aspects of sculpture and playground together in Test Site. Despite providing mats for sliders to ride on, and padding to make landings as comfortable as possible, a small number of accidents led to personal injuries being sustained by people holidaying in London.

Art and accident claims
Some art plays directly with the concept of personal injury. The artist Chris Burden's installation, Samson, consists of a huge jack between the walls of the gallery, which is connected to the turnstile through which viewers enter. Theoretically, if enough people enter the exhibition, the building could be destroyed, causing potentially fatal personal injury to those within.

Urs Fischer's exhibition in New York, You, came with a sign at the edge of the gallery saying "THE INSTALLATION IS PHYSICALLY DANGEROUS AND INHERENTLY INVOLVES THE RISK OF SERIOUS INJURY OR DEATH". The edge is all that remained of the gallery floor; an eight-foot crater intervenes in a viewer's experience of the museum trip.
