Successful skiing holiday accident claim
We received an urgent call back request from a man who lives in Southampton, Hampshire, after he suffered personal injuries in a holiday accident in Jackson Hole, Wyoming. We called the man back at the time he requested and he told us the following.
He had booked a trip for himself, his wife and their two children in December 2004 and contacted us to make a compensation claim after he and his wife were involved in holiday accident that left them unable to ski or enjoy a trip that he had booked through his tour operator.
After three days out on the slopes they were really getting back into the swing of things. The children had had some private tuition and the adults were building up to going off-piste skiing on Jackson's Big Draw during the second week of their stay.
On day four the whole family ventured on a day trip to Yellowstone National Park where they enjoyed a tour by snowmobile, saw herds of American bison and witnessed Old Faithful blowing her top right on cue.
Days five to eight were spent back on the pistes but on day nine the man had booked for himself and his wife to go and have a thermal dip at the Granite Hot Springs close to Jackson. The trip was an anniversary surprise for his wife and included a tour of the surroundings by dog sled as well as a dip in the warm bathing pool followed by a slap-up 3-course lunch. He was sure that she would be delighted.
A turn for the worse
Their trip didn't go quite to plan. A coach picked the couple up from their apartment in Teton village and left for the next pick up point. But on the way the coach was involved in a vehicle accident. A car pulled out in front of the coach and sent it careering across the road at around 20 mph. This jerked the passengers forwards and backwards and many sustained whiplash injuries and head injuries.
The man and his wife were among those that suffered whiplash during the holiday accident, meaning they had to be taken back to their apartment. They did not get the chance to go on their trip to the hot springs and they were unable to enjoy any more skiing for the remaining five days of their holiday.
They were clearly disappointed and so were their children who were looking forward to spending some time skiing with their parents now they had completed their lessons. The couple decided that they wouldn't return home as it was unfair on their children but they sought advice from an onsite medic, who suggested that they take pain killers, get plenty of rest and try some gentle mobility exercises in a few days to ease the whiplash symptoms.
It wasn't until the couple arrived back in England that they decided they would pursue a holiday accident claim against their tour operators who organised the coach ride and trip to the Granite Hot Springs. Two weeks after the road accident occurred the man was still suffering from chronic neck and shoulder pain and found himself having to take extended leave from work.
