By utilising safe working practices forklift accidents can be prevented and personal injury claims averted. Under Health and Safety Executive (HSE) regulations companies are required to effectively plan, organise, control, monitor and review traffic on all building and construction sites so that all persons are able to work and move around the area in safety.
However, in June 2009, reports from a court hearing revealed that even the most health and safety conscious firm can fall foul of the regulations and circumstances can prevail which might see an unfortunate accident.
The accident in question occurred in August 2007 when a worker, employed by a sub-contractor, was installing a fire-protection system at a site in Corby, Northamptonshire. The man was walking away from a forklift truck whilst carrying a piece of plasterboard. The driver of the vehicle did not see the worker and reversed over him causing a forklift accident that left the fire-system installer with extensive injuries.
His left tibia and fibula were broken and he received injury to his left foot, including a broken ankle. He also dislocated a bone in his right leg. His injuries required extensive surgery and at the time of the hearing he had been unable to return to work.
The construction company were quick to admit liability for their part in the accident after breaching the Health and Safety at Work Act.
A spokesperson for the company commented, "The magistrate noted it was an isolated breach and our company had properly reported the accident. We are recognised as having one of the best health and safety records in the industry and any accident is an accident too many for us."
The company was fined £15,000 and ordered to pay £13,540 in costs. It was unclear at the time whether the worker would pursue a civil action against the company, but after the outcome of the initial hearing his chances of making a successful forklift accident compensation claim would be high.
