High heels could lead to work injury compensation claim

Wearing inappropriate shoes in the workplace could cause foot, leg, back and other injuries and complaints, possibly leading to a work injury compensation claim.

Women who are required to wear high heels as part of their employers' dress code were highlighted in a motion passed at the 2009 TUC Congress.

The Society of Chiropodists and Podiatrists, which promoted the motion, said that around 2 million days are lost to the economy through sickness absence as a result of lower limb disorders and a large proportion of these are a result of work activities.

Feet are exposed to many dangers at work and, like every other danger, the risk of an industrial accident from wearing unsafe shoes can be avoided or removed if employers take simple straightforward steps to protect employees.

Workers should be able to wear the footwear that is appropriate to their occupation, working environment, and feet. That means employers should ensure that the risk assessment they have to do by law includes risks to the feet.

According to the society, women workers should not be made to adhere to a dress code which can damage their feet and should have the choice to wear footwear which will not leave them prone to long term foot health problems. In addition women should feel secure in the knowledge that their employers will support them in maintaining healthy feet.

Employers are asked to work in partnership with trade unions, staff, and local Health and Safety reps to ensure that proper risk assessments are carried out, and, where high heels are deemed a health risk, should be replaced with comfortable shoes to reduce the chance of a workplace accident and possible compensation claim.

Every employee is entitled to work in a safe environment and not to be asked to take risks by their employer. Suitable clothing and equipment should be supplied or monitored to enable the employee to undertake their work without causing harm to themselves or others.
