Dangers of drop-sides and faulty product injury claims

In October 2010 a major series of faulty product injury claim cases in America was reported to be likely to lead to a change in US manufacturing laws.

Reports suggested that the manufacture of drop-side cots would be outlawed after a number of deaths and serious personal injuries to infants who had been put in the particular style of cot, which has one cot-side which "drops" or slides down so as to allow easy access to the child.

The Washington Post reported at the time that after six child injuries three US companies had recalled around 40,650 cots which may have had faulty mechanisms or could have been affected by wear and tear.

Concerns were raised after the Consumer Product Safety Commission (CPSC) found that a gap could be created between the cot side and bedding which became a significant suffocation risk to babies.

Since 2000 drop-side cots had been blamed in the deaths of at least 32 infants and toddlers in the US and had been implicated in a further 14 fatal accidents for infants.

A move to ban the manufacture of drop-side cots was proposed by the CPSC in July 2010, as well as plans to end the sale and resale of drop-side cots. Eventually, drop-side cots would be required to be removed from use in hotels, motels and all childcare facilities.

In the UK fears regarding faulty products and the dangers of drop-side cots were triggered by the mass recall of US cots, and it was revealed that a British manufacturer, Cosatto, had issued a recall on one batch of cots, whilst also issuing a repair kit for another model.

A list of guidelines for parents who use a drop-side cot was produced by the CPSC as follows:

  • Whenever you change the sheets, check that all visible fixings – every bolt, screw, track and clamp – is securely in place.
  • Make sure the drop-side is on its track and functions well.
  • With the mattress out of the cot, wiggle the cot to see how tight all the joints are.
  • If the cot remains wobbly after tightening all hardware, look for loose wood-to-wood joints that may be causing the problem.
  • Stop using the cot if loose wood-to-wood joints are found or if you cannot fully tighten any screw.

The CPSC also warned that cots more than 10 years old, and broken or modified cots should not be used.
