Compensation, exaggeration, and accident at work cases


Following an accident at work, justice is best served by honesty; exaggeration of the impact of the accident from the claimant or of the levels of training offered by the employer is unlikely to help either side in the long run.

This is shown by the case resulting from a 2007 work injury suffered by a man moving a heavy circuit breaker in Scotland, in which the injured man had claimed to suffer from an unusual chronic pain disorder following a relatively minor muscle injury.

His opponents were able to show that he had exaggerated his symptoms to the court, and on his benefits claim. Yet, despite evidence of his exaggeration, including video recordings of him carrying heavy shopping for his wife, his work accident claim was still successful.

The judge in the case said, "While he clearly exaggerated his disability in the application forms for benefits, I am not persuaded that he is to be treated as incredible or unreliable in relation to the existence of a long-term condition in which he suffers serious pain and fatigue."

The fact that the exaggeration was noted in the court record is a sign that such a technique is likely to be found out. Some commentators suggested that the claimant was lucky not to have his claim thrown out; whether or not this is true, it is advisable to act as if it were and be entirely honest with any no win, no fee solicitor appointed over a work injury claim.
