Make a holiday accident claim once you are at home

If you or your family have been unlucky enough to have suffered a personal injury that was not your fault while abroad and feel justified in making a holiday accident claim, you may believe that you should begin legal action in the country where it happened.

Most countries in Europe are members of the EU and are supposed to have common legal procedures and standards, however, this is not often the situation from a practical point of view and many unnecessary complications can arise.

Unless you are in an English-speaking country, are bi-lingual or have close friends and relatives who can help with translation, the language barrier is one of the most difficult to overcome.

In the UK, if someone is brought before a court, either as a witness or a defendant, who does not have English as his or her first language, an interpreter will be offered so that the proceedings can be understood and the hearing is as fair as possible. Court papers and other relevant documents can also be translated.

Not every other jurisdiction is the same. Although an English-speaking lawyer may be available to assist, paperwork may still be in the native language of the country where the accident took place, leaving the victim at a severe disadvantage.

Usually, suffering an accident while travelling will involve making a claim on your travel insurance policy but this will be separate to any case for compensation for injury.

The insurance company will require various pieces of documentation to support your claim for reimbursement of expenses such as medical costs and extra money which has had to be spent as a result of the incident.

This paperwork will also be useful to substantiate your case against the person or organisation which was at fault and could be due to pay damages to you.

If you have travelled abroad using a package holiday company or other travel organisation, it may have representatives who will be able to offer practical help both at the time of the incident and when seeking compensation.

As with an accident anywhere, it helps to have photographs and names of witnesses noted at the time and to make a note of the circumstances shortly after, before memory fades.

In some countries, there may be a British Embassy or Consulate which can offer assistance to UK nationals who have suffered a holiday injury or similar unexpected trouble.

Wherever in the world you or a loved one have come to harm, it is almost always best to return home to seek redress through the British legal system because not only can you be certain of the standards of justice and likely payments for any justified compensation claims but if your case is heard in a foreign court, you will only receive whatever local levels of payment are usual in that country.
