Streamlining the EU car crash holiday accident claim process
Among the most common holiday accidents that befall Brits holidaying on the continent are those that take place on the road.
In recognition of this, from 2008 it will be much simpler for UK people to claim compensation for holiday accidents that have taken place on roads within the European Union.
Essentially, the EU measures mean it will be easier for all people in Europe who have suffered a road accident while on holiday to commence a personal injury claim from their country of residence, in their native language.
As part of the changes, it will be the responsibility of car insurers to have representatives within all member states, to respond to all claims within a three-month time limit and to guarantee minimum compensation levels.
The changes come as a result of recommendations made in a report by the European Parliament's Consumer Protection Committee.
Chair of the committee, Arlene McCarthy, comments, "After the summer break millions of British holidaymakers are returning home after a holiday somewhere in the EU. Unfortunately, with 1.2 million road accidents in Europe every year, some of those holidaymakers will have been the victim of a motor vehicle accident, whether as a driver or as a pedestrian.
"We have prepared this report to ensure all holidaymakers, and also business travellers, are aware that EU law exists to make resolving an insurance claim and getting compensation as easy as possible."
"If you've been the victim of an accident while on holiday in the EU the last thing you want to do is have to deal with a foreign insurance company in a foreign language. EU law is there to make sure you can go home first, then get your claim settled quickly, easily and in your own language.
"Some claims will inevitably be contentious and not easy to settle. As the lawmaker who drafted the EU law on mediation I want to highlight the option of settling a dispute outside of court to save time and money for both sides. To protect yourself in case a claim does go to court, all consumers should look carefully at what cover they have for legal costs and consider taking out extra protection if not already covered."
