In 2009 the NHS had to face renewed accusations that it was unnecessarily dragging out the length of time it takes to settle many medical negligence compensation cases and thus adding to the legal costs associated with such claims.
Russell Levy, a leading medical negligence compensation lawyer, told the BBC, "They (the NHSLA) hope the harder they make it and the more they discourage people, they will go away.

Steve Walker, chief of the NHS Litigation Authority, told BBC Radio 4's File on 4, "The present system means there is too great a drain on public resources."
He added, "There is only one source of money for the NHS... we have to pay claims from money that would be spent on patient care."
File on 4 revealed that lengthy settlements were behind some extreme disparities between settlement sums and no win, no fee solicitor charges. For example, in one case a claimant received settlement of £5,000, while the solicitor received fees of £56,000. In another the claimant received £7,000, while the solicitor received £77,000.
