One type of building site accident that construction foremen need to be aware of is the trench collapse; indeed, it is their responsibility to ensure that the correct health and safety procedures are implemented during excavations.
Tragically, such construction accidents claim around one life each year, with many more workers suffering personal injury. As such there can be no room for the kinds of health and safety lapses that contribute to this type of building site accident.
This was illustrated in 2009 with the prosecution of a Scottish construction firm for breaches in health and safety legislation that ultimately led to the death of a 36-year-old construction worker from Glasgow.
During a hearing at Hamilton Sheriff Court, the sheriff reserved particular criticism for the foreman on the building site, saying that he had had "little regard" for the safety of the worker and had failed to observe company safety policy and had behaved in a flagrantly dangerous manner.
The sheriff commented, "Far from being the very safety-conscious individual described, he appeared, on the basis of his own evidence, to have had little if any regard for the health and safety of the men for whom he was responsible.
"The failure to install shoring to prevent the trench sides from collapsing was the most glaring and fundamental breach of safety requirements and was the main reason why this accident occurred."
This means that the man's family would have a strong case for claiming accident compensation. As the HSE has said, "Trench collapses are entirely avoidable. Without suitable support, any face of an excavation will collapse; it's just a matter of when. The steeper and deeper the face, the wetter the soil, the sooner the collapse."
