Construction site accidents and infrequent commissioners

Given the amount of time and money invested in educating the industry about health and safety, it can be disheartening to learn that many within construction have little or no knowledge of some of the obligations imposed by legislation. Indeed, one report, by Pye Tait for the British Property Federation (BPF) found that as many as two-thirds of companies engaged in commissioning building work are completely unaware of The Construction (Design and Management) Regulations 2007, the very regulations that oblige them to protect the health and safety of workers.

Tellingly, many of the uneducated are so-called "infrequent" clients - those companies such as hoteliers, farmers or training institutes who commission building work on an irregular or one-off basis. This ignorance of regulations comes despite the fact that the commissioning company can, in theory, be both fined and prosecuted for any health and safety lapses. Pertinently, it also places a great burden on contractors, who are relied on to ensure full compliance.

Just as worryingly, the Pye Tait study found that although there is better knowledge of the regulations for regular commissioners such as property developers, they have not led to a significant reduction in health and safety risks.

However, these findings are not necessarily backed up by official fatality figures, which for 2009/2010, two years after the introduction of the regulations, showed there had been a 21% reduction in construction site accident deaths compared to the previous year.

A spokesperson from the British Property Federation comments, "Health and safety is something which organisations should manage as carefully as their balance sheets. It is clear from the research that this message is not permeating outside of the regular client community and at a time where the construction industry is suffering under huge cuts, it is vital we do not up the burden further."

While Jon de Souza, chief executive of the Construction Clients' Group, believes that the study shows the regulations are failing. "The findings of the report confirm that changes are needed to the legislation to deliver their intent," he said.

Adding, "We would like to see the Health and Safety Executive commit to a root and branch review of the regulations and also refresh their communication strategy with the general business community."
