Construction site accident claims and the dangers of scaffolding

Construction sites are notoriously dangerous places which is why so much health and safety legislation surrounds them. The combination of heavy lifting equipment and weighty materials means that when a construction site accident does occur, it can lead to serious personal injury and even death.

While compliance to safety guidelines may at times seem tedious, the simple act of checking a piece of equipment over before its use can mean the difference between life and death for the worker using it.

The case of a father who became buried in cement after his scaffolding collapsed highlights just how important site safety really is. The incident happened after the builder fell through foundations landing five metres below on his ankle at the Freeman Hospital's cancer centre site in Newcastle.

After cement was poured into the foundations, the worker was left with severe cement burns as well as a broken ankle and post traumatic stress disorder for a number of years. Speaking of his experience, the father-of-two from Houghton-le-Spring said it was the worst experience he had ever had in his life and he would be scared to ever step onto a construction site again.

He said: "When the concrete started pouring on top of me I thought it was the end.
"I thought I was dead. It was so heavy I couldn't get out of it. It was absolutely terrifying."

After three operations on his ankle and counselling to deal with the flashbacks and nightmares he suffered from, the man was unable to return to his building job and had to take a pay cut to work as a refuse collector instead.

Following his ordeal, the worker made a successful compensation claim for the injuries he sustained and was awarded an undisclosed compensation amount.

This demonstrates how the utmost care must be taken when erecting scaffolding towers. Although outside contractors are often used to construct scaffolding, workers using the scaffolding should carry out their own checks to ensure the towers are safe before they use them.

Construction companies have a duty to safeguard the wellbeing of their staff. If you suffer a personal injury due to employer negligence, you have the right to make a compensation claim.
