Construction accidents, youclaim.co.uk

Claiming for latent construction injury

Not all cases of construction injury are immediately obvious. In fact, some occupational illnesses have a long latency period, sometimes up to 40 years, and may only become apparent after the affected worker has ceased to work with the liable employer.

In fact, there are a great number of industrial illnesses associated with the construction industry that have a long latency period. These include:

Illnesses and injuries associated with, carcinogenic chemicals, gases and dusts

Vibration-related injuries such as raynauds and VWF

Respiratory illnesses and lung diseases such as asthma and emphysema

Skin conditions such as dermatitis

Systemic poisoning

Neurological disorders

Asbestos-related conditions such as mesothelioma and asbestosis

Difficulties with figures
Unfortunately, unlike with construction injury caused by sudden workplace accidents, it is difficult to ascertain an accurate figure for illnesses with a long latency period. This is because victims often fail to make the connection between former working conditions and the onset of illness in later life. Furthermore, medical experts may also fail to make this link or mistakenly attribute a death to natural or degenerative causes.

Finally, there is often a bureaucratic failure to report the illness as a cause of death. This is certainly the case with mesothelioma, with experts estimating that as many as one in five deaths may go unreported.

Ken Takahashi, the co-author of a report into the subject comments, "Our most important finding is the magnitude of unreported mesothelioma in countries that use asbestos at substantial levels but report no cases of the disease."

Maximum compensation for a construction injury
Working on site can be dangerous, but it needn't be.

When workers have the full protection and concern of their employers and if best health and safety practice is followed, accidents do not happen.

It is when health and safety laws are breached that workers suffer injury and it is in these instances that they are entitled to claim compensation.

Here at YouClaim, our no win, no fee solicitors provide construction injury claimants with a completely cost free work accident litigation service, win or lose.

Furthermore, as we never take a cut, we guarantee 100 per cent compensation in every won case.
