The inquest heard how the 22-year-old builder was working on a house extension when a trench collapsed, burying him under thick clay. He had been accompanied by a digger driver who witnessed the accident and said, "I was digging with the machine." I turned around to open the bucket of mud into the dumper and as I turned aroundI noticed the trench had collapsed."
Despite his colleague's attempt to release him with a shovel, it proved impossible to rescue him without the help of the emergency services who declared him dead an hour later.
The owner of the construction company said the experienced builder understood the 'golden rule' that nobody should ever go into a trench more than 1.2 metres deep. However, the court heard that the deceased had never been on an official health and training course with the company and precautions to prevent entry into the trenches were 'insufficient'.
At the inquest, the coroner summarised that the deceased had effectively been buried and encased in the thick clay and the effect of that prevented his chest moving.
"It was like being in a vice. He would not have been able to breathe and he would have died rapidly," the coroner declared.
During the inquest, the deceased's family described him as "a hard-working, non-drinking, non-smoking individual who put his family, friends and total strangers before himself."
After the inquest his father made a statement saying, "We have now got to wait for the HSE reports, whether they are going to prosecute or not and we are taking out civil proceedings. We are still fighting for justice."
