In 2010, the first steps in offering compensation for product liability were made in a global faulty product issue which had affected Toyota owners worldwide.
Concerns were initially raised after a California car crash in August 2009 which saw the deaths of three adults and a 13-year-old girl, who were travelling in a Toyota Lexus ES, which had been borrowed from a dealership while the driver's vehicle was being serviced.
The issues regarding defective accelerator equipment and systems was brought into the public eye after a tape of the emergency call made by the occupants of the doomed vehicle was released. Screams were clearly heard as the car sped up, as was the protestation, "there's no brakes!"
The product liability lawsuit was filed by parents of the victims and was considered to be the strongest case among hundreds of claims made for sudden acceleration issues brought against Toyota.
A statement released by Toyota said, "Through mutual respect and cooperation, Toyota and the [claimant] families reached an amicable agreement in mediation that fully resolves these claims without the need for litigation.
Worryingly, even though Toyota issued a massive product recall, arguments still raged between automotive experts and the car manufacturer about what actually caused the crash and the many other instances of sudden acceleration.
Toyota maintained that incorrectly fitted mats were to blame and no electronics fault was ever identified. However, a personal injury lawyer involved in the case argues that investigations have been inconclusive and that the circumstances of the accident could not have been caused by ill-fitting mats alone.
He said, "We view this as 100% a problem of the design of the vehicle."
Toyota were, at the time, trying to get hundreds of other compensation for product liability claims dismissed from court on the grounds that their investigations had failed to find any electronic defect which could have caused the various incidences of sudden acceleration.
