Compensation for delayed surgery with specialist solicitors

In the event that a hospital or medical professional fails to carry out an appendectomy when one is needed and the individual suffering from appendicitis goes on to suffer injury, it may be possible to claim compensation for delayed surgery.

For example, in October 2005 a 36-year-old woman attended a Manchester hospital suffering from diarrhoea and complaining of acute abdominal pain.

Furthermore, she had also developed an infection, so was again prescribed antibiotics.

Two-years later, the woman tried to have a second child; however, it was discovered that her ruptured appendix had damaged her ovaries and fallopian tubes. Both the delay in performing surgery and the consequent infection were seen to be factors in reducing the woman's fertility. As such she was awarded a five-figure sum of compensation of delayed surgery.

A no win, no fee specialist said of the case, "Expert opinion determined that the hospital was negligent in failing to diagnose the woman's appendicitis and negligent in providing her with prompt surgery.

"Had it not been for these failings, it is probable that today she would have the two-child family she always dreamed of having. This is why compensation was deemed payable."
