When claiming compensation for asbestosis or asbestos cancer there may be several different conditions under which the litigation may be brought. Depending on your particular diagnosis and the circumstances under which you were exposed to asbestos, the scale of your damages award will be calculated accordingly.
Asbestosis – a definition
Asbestosis occurs when asbestos fibres are inhaled causing the development of lung fibrosis - formation of excess fibrous tissue in the lungs - and a diagnosis of asbestosis will be made on the basis of clinical symptoms, X-ray examination and a long history of continued exposure to asbestos.
The excess fibre in the lungs leads to a reduction in lung function and this will manifest primarily as shortness of breath, but a sufferer may also experience a symptomatic cough and / or a feeling of chest constriction.
In most cases the primary treatment for asbestosis will be the administration of oxygen therapy, which can be done at home. Doctors may also prescribe medication, and all asbestosis patients are advised strongly to give up smoking.
Unlike mesothelioma – the malignant cancer of the lung covering also caused by asbestos inhalation – asbestosis will only be the diagnosis if the patient has a long history of asbestos exposure, such as having worked as a plumber, pipe lagger, construction worker or those who worked in vehicle maintenance dealing with brake pads.
Although an asbestosis diagnosis does not necessarily mean the sufferer has cancer, they are at significantly greater risk of developing lung cancer and further respiratory problems as a result of their exposure to the deadly mineral.
If exposure to asbestos was caused by an employer failing to protect their employees then there will be grounds to start a claim against the employer for compensation for asbestosis.
