During his two-day absence, he took a drug overdose which made him unconscious and he lay heavily on his left leg in such a position that the circulation to the limb was cut off. Complications resulting from this trauma led to amputation of the leg but the man claims his situation has been caused by the action of the medical staff in allowing him to expose himself to such danger.

Some people with mental health problems may have their condition kept under control through medication and if this is not strictly supervised can lead to the patient becoming unstable with the possibility of causing harm to himself or others. As the patient may not be regarded as totally responsible for their actions, it could be perceived that medical negligence could have occurred.

Depending on the severity of the mental condition, the courts may regard the patient as having only as much control over their actions as a child and, therefore, the health authorities should be taking particular care to supervise him.
