When treatment goes wrong it's clinical negligence

With the advancement of medical procedures and the vast technological know-how behind all areas of healthcare, it is often surprising to see the basic nature of many claims for clinical negligence compensation.

A case which came to light in 2010 involved one of the oldest types of medical procedure which had been carried out negligently and caused a young boy to suffer debilitating personal injury.

The boy, from Manchester, had been born with a congenital hip defect which meant his hips were out of alignment. Hip dysplasia is a fairly common birth defect which affects approximately 1.5 out of every 1,000 babies born.

Pregnant women are routinely warned about the possibility of this problem and all babies should be checked shortly after birth and throughout the first year of life.

In the case of the boy who had been born at the Royal Oldham Hospital, after ten years of treatment for hip dysplasia he was left with one leg shorter than the other, a pronounced limp and the prospect of full hip replacement surgery in the future.

The clinical negligence compensation claim focused on the hospital's early treatment of the boy. Shortly after birth, on the discovery that he had bilateral dislocateable hips, he was put into a harness to stabilise the condition, but when this did not prove effective a body splint was fitted.

The baby's mother was concerned about the effectiveness of the treatment and made her feelings known to doctors who sent the boy for an ultrasound scan. The scan revealed that his hips were not aligned properly.

As the medical negligence claim was pursued his mother commented, "By not treating it properly when he was very young, vital time was lost.

"Consequently we now have to wait for a double hip replacement when he is older for him to have a normal life."

The NHS trust responsible for the boy's care admitted failings in their treatment of his hip dysplasia.

A spokesperson commented, "The trust is pleased that a settlement has been reached. We would like to offer Hayden and his family our sincerest apologies."
