Clinical negligence claim for surgical error

When you go into hospital for an operation, you expect to be able to place all of your trust into the healthcare professionals who will be looking after you. If that procedure goes wrong due to malpractice on behalf of one of the medical professionals, that trust can be destroyed. In such a scenario, a clinical negligence claim may be made against the hospital to gain compensation for the personal injury suffered by the patient.

Urology procedures can be particularly delicate and a slip up in this area can lead to sensitive problems. In 2007, a patient lost a testicle during an operation after it was accidentally removed in a surgical blunder.

The patient in question had a cist on his right testicle which required removal. Unfortunately the surgeon performing the procedure mistakenly removed the whole of the testicle instead of just the lump. Although medical staff quickly realised the mistake, nothing could be done to reverse the removal.

Sadly, this is not the first time that such an unfortunate medical negligence case has happened. In January 2009, a patient was left infertile after doctors removed part of the patient's good testicle before realising their mistake and removing the other one.

Doctors at the West Suffolk Hospital in Bury St Edmunds had to cut away the man's right epididymis which is the part where mature sperm is stored. However, they accidentally removed the left one before realising their mistake and removing the correct one as well. This left the patient, who was only 17 at the time, permanently infertile.

A major investigation was launched into the medical negligence case and the hospital involved declared that tougher safety measures had since been introduced to ensure a similar incident doesn't happen in the future.

Preparation for such procedures normally includes clear note taking of the particular part which needs removal. When this is on a body part that there is more than one of, such as the testicles, clear marking should be made on the part requiring removal.

Such a simple step such as marking the correct limb before the procedure is not time consuming yet can help prevent against medical errors such as the aforementioned cases of testicle removal.
