When you have received the news that you or a loved one has cancer, you want to ensure that everything possible is done to give you or your loved one the best possible outcome. Making a clinical negligence claim during such a stressful and worrying time should be furthest from your mind as you concentrate on getting yourself or your loved one better.
Early diagnosis is often essential for treatment to be most effective so when you are concerned about a lump you have found or are experiencing worrying symptoms, you want to make sure they are checked out quickly.
While quite often these symptoms turn out to be nothing serious, sometimes they can be more sinister and require further investigation by more specialised doctors or consultants. This can lead to long delays as appointments for further investigative procedures and consultant appointments have to be found. Unfortunately, sometimes this can lead to patients being "lost in the system" as follow up appointments fail to be made or notes are not passed on to the relevant people.
A former paramedic who died from cancer is an example of such an occurrence. After cysts were found on the 59-year-olds kidneys, they were said to be benign. Tests in 2005 however revealed that these cysts had become malignant and cancer was also found in his lungs. Regardless of these worrying test results, they were not passed on to a specialist for a year which resulted in severe delay to the man's treatment. While it is unknown if this could have affected the patient's prognosis, it certainly allowed the cancer to spread more rapidly, limiting his life expectancy and giving him less time with his loved ones.
His wife has since made a medical negligence compensation claim against her local healthcare trust for their poor handling of her husband's treatment. She argues that serious diagnostic mistakes were made by her NHS trust and wants recognition of that fact.
Dealing with the loss of a loved one through cancer is an awful thing to go through no matter how well prepared you were for their death. Finding out that more could have been done to save them or prolong their life is likely to make this sorrow even harder to deal with.
