Clinical negligence and never-ever events

One way to ensure that wholly avoidable and unacceptable incidents of clinical negligence never take place is to withdraw funding from the hospitals that make these negligent mistakes.

As such, in 2011 the health minister drew up a list of 25 types of medical error which experts believe should be classified as automatically unacceptable. Those hospitals found guilty of these so-called "never-ever" clinical negligence events risk losing vital funding.

The health minister commented, "Improving patient safety is central to this. We have identified 25 preventable incidents – never events – which should never happen in a high-quality health care service and for which payment can be withheld across the NHS."

Any patient who suffers a never-ever event is likely to be able to mount a strong case for receiving 100 per cent compensation. The list of never-ever events includes:

  • Incorrectly administered insulin;

  • Incorrect blood type transfusions;

  • Opiod overdose;

  • Post caesarean haemorrhage;

  • Amputation of wrong limb;

  • Causing scalding injury to patients;

  • Injectable medication negligence;

  • Inserting wrong implant;

  • Leaving objects inside a patients body during operation;

  • Allowing patients to fall from windows.

"Never-ever events are called so for a reason," says a spokesperson from compensation firm YouClaim. "They should never, ever be allowed to happen, which means they are indefensible – there are no excuses.

"We all pay when these incidents occur, but none more so that those directly affected. For example, in 2010 there were 111 recorded incidents of never-ever events, costing the taxpayer around £3.9 million in medical negligence compensation."
