Make a clinical and medical negligence claim for your swine flu misdiagnosis

Clinical or medical negligence as it is also known can have a huge physical and psychological impact on a patient as not only does it cause unnecessary or prolonged suffering, but it also damages the confidence you should be able to place in your healthcare professional.

When the patient is a child, the trauma of a medical error is not just limited to the patient, but to the parents as well. Having a sick or injured child can be a time of extreme stress and worry for any parent and the comfort of knowing their child is being well-cared for may offer the only reassurance. However, after a medical negligence claim, faith in the healthcare system will undoubtedly be lost and the confidence once held in the diagnosis of a doctor will be broken.

While medical negligence may just mean a longer recovery time and hospital stay, tragically, in some cases it may lead to the loss of a patient. The loss of a child under any circumstance is an impossible burden to bear, but when it has been caused by the medical professionals that should have been working to treat that child, their death can be even harder to deal with.

Sadly, the case of a two-year-old girl who died from swine flu illustrates this. The mother of the girl had recently suffered from the virus herself and after the two-year-old started developing similar symptoms, she took her to Bristol Children's Hospital. Despite the parents' concerns, doctors discharged the girl telling them to give her Calpol and water.

Sadly, over night, the child's symptoms worsened and she stopped breathing later the next day. Despite the best efforts of her parents and paramedics to resuscitate her, she was pronounced dead at the hospital.

The post-mortem revealed the child had died from pneumonia caused by influenza. Following the result, her parents made an official complaint to the hospital with the belief that if doctors had not discharged their daughter, she may still be alive.

This case illustrates how parents' instinct may be right. Hospitals are often reluctant to admit people with flu as usually patients can be treated at home. Due to the contagious nature of swine flu, hospitals may also be reluctant to admit people suffering from the illness due to the risk of a spread of the infection.

Swine flu is usually a mild illness presenting no different symptoms to normal flu; however, for the vulnerable such as the very young, it can be more serious. Had doctors examined the two-year-old more thoroughly, they may have decided to admit her and such a tragic outcome may not have occurred.
