In 2010 there was a landmark court ruling which made it considerably easier for certain people claiming compensation for asbestosis to receive settlement.
Prior to the ruling it was necessary to show medical evidence confirming the existence of at least 20 million asbestos fibres in the tissue samples of claimants.
However, the 2010 claim, which was being made by a 76-year-old widow whose husband died in 2006, was awarded settlement after no win, no fee solicitors succeeded in proving that the threshold for causality was too high, citing an American study whose findings supported this position.
As such, the widow received a payout of £100,000, despite tissue samples from her husband showing the existence of only 7 million asbestos fibres, with the judge hearing the case ruling that the previous level of proof was "set too high, probably significantly too high''.
The solicitor who represented the claimant said that the decision would help thousands of people when it comes time for them to be claiming compensation for asbestosis.
"This is a landmark decision that will benefit thousands of people throughout the country," he said.
Adding, "Asbestos disease is massively debilitating, painful and distressing to live with and can very often prove fatal. Compensation for those who have been negligently exposed to asbestos dust cannot restore health, but it can help improve quality of life for sufferers and their families.''
The court agreed with arguments that the deceased man developed asbestosis after being exposed to dust from sacks of raw asbestos while working as a lorry driver for British Rail between 1958 and 1962.
