Hospitals and surgical staff have a duty to ensure that patients receive a safe level of care. This includes an obligation to ensure that patients are operated on with safe materials which meet safety requirements. As such, if surgical tools or products are unsafe and cause patients to sustain injury, care providers may be liable to pay surgical error compensation.
Counterfeit surgical mesh claims
In 2010 in the United States of America it emerged that a number of hospitals had been unwittingly using counterfeit surgical mesh.
News of the scandal caused particular alarm for those patients who had surgical mesh implants, as well as hospitals, surgeons and other medical staff.
The Food and Drugs Administration (FDA) recommended that hospitals immediately stop using the mesh. It also said that all affected patients should be closely monitored in order to observe if there were any adverse reactions to the counterfeit mesh.
An FDA spokesperson commented, that the counterfeit mesh could "mean an increased risk of infection if they are implanted in a patient.
"Also," he added, "the counterfeit may not have properly finished edges, which could allow it to unravel."
The impact of the scandal
In 2011 it was announced that the companies which had supplied hospitals with the counterfeit mesh were being sued for surgical error compensation by a man who developed a severe infection as a result of their use.
Furthermore, personal injury lawyers said that there could be a further 150 claims related to the scandal.
