In 2011 an American man began medical negligence proceedings against a surgeon after having his penis amputated during an operation – he claimed this happened without him having given his consent.

The surgical error compensation claimant had been booked in to have a routine circumcision in order to treat penile inflammation – however, on waking from the surgery the man was horrified to discover that is penis had been amputated.

Although the man then made a successful claim for surgical negligence compensation against the hospital where he'd had the operation, he subsequently also sought to claim compensation direct from the surgeon.

Despite the success of the earlier claim, the surgeon said that he would seek to defend the second action, contending that he found penile cancer during the procedure and that this had necessitated the amputation.

For the claimant and his legal team, this argument was immaterial. "He's angry because [the surgeon] took off his penis without asking; without giving him a choice; without giving him the opportunity to check around and talk to other people," said the man's personal injury lawyer.
