Although these exceptions exist, those in charge of working under these circumstances still have a duty to ensure the health and safety of workers and must abide by the Control of Asbestos Regulations 2006.
Indeed, it is unfortunate that many workers are still exposed to the invidious industrial killer, even when the health and safety advice is clear.
The Health and Safety Executive releases regular updates of prosecutions and warnings related to asbestos breaches.
For example, in one typical one-month period, the HSE fined a school for disturbing asbestos in its buildings, fined a shopfittinf firm in Manchester for exposing workers to the substance and fined a property developer for exposing both workers and members of the public.
